Subject matter of the contract
LMSGear J. Schorat sells the goods specified in the Online Shop to the Customer subjectto the following Terms and Conditions of Delivery and Sale (GTC).

2. conclusion of contract
The contract between the customer and LMSGear J. Schorat is only concluded by an order of the customer and its acceptance by LMSGear J. Schorat. The order of the customer takes place via internet. LMSGear J. Schorat accepts the order by sending the customer an order confirmation by e-mail or by delivering the ordered goods.

3. product offer
All information on the goods that the customer receives during the ordering process is non-binding. In particular, we reserve the right to make changes in design and technology that do not significantly affect the function, as well as errors in descriptions, illustrations and prices. All technical information on the individual goods is based on the manufacturer's specifications.

4. terms of payment
All prices are continuously adjusted to the market and the current exchange rates. They are in Euro (€), EXW from stock and include 20% VAT. Shipment will be made after advance payment by bank transfer or Paypal.

5. delivery conditions
If in stock, the products will be delivered to the address specified by the customer as soon as possible. For all goods that must first be delivered to us, stated delivery times are always non-binding. A claim for damages against us due to non-delivery because the manufacturer or supplier did not deliver or did not deliver on time is expressly excluded. Likewise, no liability is accepted for any damage to persons or property caused by the use of the delivered items. The costs for uncollected or refused consignments will be charged to the purchaser plus a handling fee of € 30.00.

6. retention of title
The delivered goods remain the property of LMSGear J. Schorat until full payment has been made.

7. right of return
The customer has the right to revoke the conclusion of the contract within a period of 10 days without giving reasons and to return the goods. The goods delivered by us must be returned undamaged, functional, complete and in perfect original packaging and condition. The purchase amount will be refunded. Postage will not be refunded.

8 Warranty for defects
Unless otherwise stated, the warranty period for all products offered in the catalogue is 24 months from the date of purchase. The warranty covers all material and production defects. The guarantee becomes void if unauthorised modifications or repairs are made to the goods. Improper handling will also invalidate the guarantee.

9. data protection
The personal data entrusted to us by the customer will be treated as strictly confidential and will not be passed on to third parties.

10. place of jurisdiction
Place of jurisdiction is St. Gallen SG.

Infringements of copyright will be prosecuted under criminal and civil law, if necessary with the assertion of claims for damages.

12. final provisions
The General Terms and Conditions may be amended by LMSGear J. Schorat at any time.
